2. General provisions, scope of application of the T&Cs

2.1. These General Terms and Conditions (hereinafter referred to as "T&C") govern the contractual relationship for the purchase of products offered by the Seller via the canna4bliss.com website (hereinafter referred to as the "Website") between the Seller and the natural or legal person purchasing the products (hereinafter referred to as the "Customer" or "Buyer").

2.2. By placing an order on the Website, the Customer declares to have read and accepted the terms contained in these T&Cs, as well as those described in the Privacy Policy and the Cookies Policy.

2.3. The main and official language of these T&Cs is the Spanish. Any other language versions available on the Website (including machine translations, e.g. those generated by TranslatePress Pro) are provided for information purposes only. In the event of any discrepancy or dispute, the text of the Spanish T&Cs shall always prevail.. We recommend that you also check the Spanish version.

3. Conditions relating to the Client

3.1. The Customer declares to be of legal age (having reached the age of 18), to have full capacity to act, or to be a representative of a legal entity, and to be authorised to enter into a contract. In order to make purchases on the Website, the Customer must confirm that he/she has reached the age of majority of 18 (through the age verification system).

3.2. The Customer is responsible for the accuracy and truthfulness of the data provided during the registration and ordering process. The Seller is not liable for any damages or problems resulting from inaccurate or false data provided (e.g. failed delivery).

4. The Products and their information

4.1. The Website presents the products marketed by the Seller (hereinafter referred to as the "Product(s)"). The Seller endeavours to describe the essential characteristics of the Product(s) as accurately as possible and to present true-to-life images. The Seller accepts no liability for any inaccuracies, but will make every effort to correct them.

4.2. Warning on the nature of the Products: The products marketed on the Website may contain cannabidiol (CBD), a non-psychoactive component of the cannabis plant. These products are marketed in Spain exclusively as cosmetics for external use and are not considered medicines. They are not suitable for diagnosing, treating or preventing diseases. According to Spanish legislation, products containing CBD can contain a maximum of 0.2% THC (tetrahydrocannabinol). Please read the label and product information carefully before use. If in doubt or if you have a medical condition, consult a professional. The Seller assumes no responsibility for the consequences of improper use of the products.

4.3. The availability of the Products indicated on the Website is indicative (subject to stock availability). The Seller reserves the right to discontinue or limit the marketing of certain Products without prior notice.

5. Prices and taxes

5.1. The prices indicated next to the Products on the Website are expressed in Euros (EUR).

5.2. Prices are finalised during the ordering process, on the checkout page, and including applicable value added tax according to the country of destination (Customer's shipping address) (within Spain, VAT or IGIC if the shipment is to the Canary Islands; for shipments to other EU countries, the VAT of that country) at the legally established rate, in accordance with EU rules on distance selling.

5.3. Prices do not include shipping costs, unless expressly stated otherwise (e.g. free shipping promotion). Shipping costs are calculated and displayed during the ordering process, before payment, depending on the delivery address.

5.4. The Seller reserves the right to change prices without prior notice. The change shall not affect orders already confirmed. In the event of a manifest error in the price (e.g. price of 0 EUR), the Seller shall not be obliged to supply the product at the incorrect price, shall inform the Customer thereof and shall offer the Customer the possibility to purchase at the correct price or to cancel the order.

6. Ordering process

6.1. The Customer selects the desired Product(s) on the Website and adds them to the "Basket" or "Cart".

6.2. After reviewing the contents of the Basket, the Customer continues the order by clicking on the "Checkout" button (or similar).

6.3. The Customer provides billing and shipping details, selects the shipping method and accepts these T&Cs.

6.4. The Customer selects the method of payment (currently: direct bank transfer).

6.5. Before finalising the order, the Customer has the possibility to review and modify the data entered and the content of the order.

6.6. The order is sent by clicking on the button "Place order" (or similar), which implies an obligation to pay.

6.7. The Seller shall confirm receipt of the order by means of an automatic e-mail to the e-mail address provided by the Customer. This e-mail does not constitute the formalisation of the contract, but simply records the receipt of the order. It will also contain the bank details required for payment.

6.8. The contract shall be deemed concluded when the Seller expressly confirms the acceptance of the order and/or the delivery of the product(s) by means of a separate e-mail.

6.9. The Seller reserves the right to refuse an order (e.g. lack of stock, payment error, non-compliance with the T&C), informing the Customer by e-mail.

7. Method of payment

7.1. Payment of the price of the Products purchased on the Website is currently made by means of direct bank transfer (payment in advance).

7.2. After placing the order, the Customer will receive by e-mail the Seller's bank account number (BBVA) and the other information required for payment (e.g. order number as the reason for payment).

7.3. The Customer shall transfer the total amount of the order (price of the product(s) + shipping costs) to the indicated bank account of the Seller within the following period 5 working days. Please indicate the order number in the concept of the transfer.

7.4. Shipment of the Product(s) will only commence once the full amount has been credited to the Seller's bank account. If the amount is not received within the specified period, the Seller shall be entitled to cancel the order.

7.5. The Products shall remain the property of the Seller until the price has been paid in full (retention of title).

8. Shipping and delivery

8.1. The Seller shall ship the ordered Products to the shipping address provided by the Customer.

8.2. Transport partner: Correos (Spain).

8.3. Shipping areas: The Member States of the European Union where the sale and shipment of these products are legally permitted. It is the Customer's responsibility to verify the specific import regulations of their country of destination. The Seller reserves the right to refuse shipments to certain areas if legal impediments arise.

8.4. Shipping costs: The shipping costs **will vary depending on the weight of the package and the place of delivery (destination country)**. The system **will automatically calculate and display the exact shipping cost (including VAT/IGIC of the destination country) during the order process on the checkout page**, after entering the shipping address and before confirming the payment.

8.5. Estimated delivery time: After receipt of payment and dispatch of the parcel, the estimated delivery time is generally 7 working days within Spain and up to 3 weeks for other EU territories.. These delivery times are approximate and may vary due to the workload of the postal services or other causes beyond the Seller's control (e.g. customs clearance for territories outside the EU customs union [if applicable]), and may sometimes exceed 3 weeks. The Seller shall make every effort for prompt delivery, but shall not be liable for delays on the part of the transport partner. In case of significant delay, the Seller will inform the Customer.

8.6. The Customer must inspect the package at the time of delivery and, in the event of visible damage, note this on the carrier's delivery note and inform the Seller immediately.

8.7. The transfer of risk occurs when the Customer takes physical possession of the Products.

9. Right of withdrawal

9.1. The Customer who is a consumer in the European Union and Spain has the right to withdraw from the contract without justification.

9.2. The Customer has a period of 14 calendar days from the day on which it acquired the material possession of the Product(s) to exercise the right of withdrawal.

9.3. Exceptions to the right of withdrawal: The Customer may not exercise the right of withdrawal, inter alia, in the following cases:

  • The supply of sealed goods which are unsuitable for return for reasons of health protection or hygiene and which have been unsealed after delivery. This applies to the cosmetic products containing CBD (e.g. oils, creams) marketed on the Website, if the Customer has opened the protective packaging of the product (e.g. seal, seal). Please note that you will lose your right of withdrawal if you unseal these products. The Customer is informed of this circumstance prior to purchase on the product page and here in the T&C.
  • The supply of goods that are likely to deteriorate or expire quickly.
  • The supply of goods made to the Customer's specifications or clearly personalised.
  • The supply of sealed sound or video recordings or sealed software that has been unsealed by the Customer after delivery.

9.4. Exercise of the right of withdrawal: The Customer must communicate its decision to withdraw from the contract by means of an unequivocal written **declaration, preferably by e-mail to info@canna4bliss.com**, within a period of 14 days. The communication must include the Customer's name, address, order number and a clear statement of the Customer's wish to withdraw from the contract (the use of a model withdrawal form is not compulsory).

9.5. Obligations of the Client in the event of withdrawal: The Customer must return the Product(s) (to which the right of withdrawal applies) without undue delay and in any event not later than 14 calendar days from the date on which he/she communicates his/her decision to withdraw. The time limit shall be deemed to have been met if you return the goods before the time limit has expired.

9.6. Cost of return: The direct return costs of the Product(s) shall be **assumed by the Customer**. The Seller will not accept parcels sent carriage forward or cash on delivery.

9.7. The Customer shall be liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

9.8. Obligations of the Seller in the event of withdrawal: The Seller shall reimburse any payment received from the Customer, including the costs of delivery (with the exception of the additional costs resulting from the Customer's choice of a delivery method other than the least expensive standard delivery method offered by the Seller), without undue delay and in any event not later than 14 calendar days from the date on which the decision to withdraw is notified. The Seller may withhold reimbursement until it has received the goods, or until the Customer has provided proof of the return of the goods, whichever condition is met first. The reimbursement shall be made using the same means of payment used by the Customer for the initial transaction (bank transfer), unless the Customer has expressly provided otherwise.

10. Guarantees

10.1. The Seller shall be liable for any lack of conformity which becomes apparent at the time of delivery of the Product.

10.2. Legal Guarantee of Conformity: The legal guarantee of conformity also applies to products containing CBD, in accordance with Spanish law. This means that the Seller is responsible for the Product sold being in conformity with the contract at the time of delivery (e.g. quality, described characteristics). According to Spanish regulations in force since 1 January 2022, for new products, the legal guarantee period is 3 years from the delivery of the Product. During this period, if the Product does not conform to the contract (is defective), the Customer is entitled, in the first instance, to have the Product repaired or replaced free of charge. If this is not possible or is disproportionate, the Customer may demand a price reduction or termination of the contract. In the absence of proof to the contrary, it shall be presumed that any lack of conformity that becomes apparent within two years of delivery of the Product was already present when the Product was delivered.

10.3. The above shall not apply if the defect is due to improper use of the Product. It is important that the Customer uses the Product in accordance with the instructions for use.

10.4. The Customer must inform the Seller of the lack of conformity within two months of becoming aware of it.

10.5. Procedure for exercising the guarantee:

  • Please contact our customer service department at info@canna4bliss.com as soon as it detects non-conformity.
  • In your communication, please describe the defect in detail and attach a copy of the purchase document (invoice or order confirmation). Attaching photos or videos of the defect may speed up the process.
  • Our customer service will contact you to inform you of the steps to be taken, including the possible return of the product for inspection, repair or replacement at the Seller's expense (the exact method to be agreed with the Seller).

10.6. Commercial Guarantee: The Seller does not offer no commercial guarantee in addition to the mandatory legal guarantee of conformity.

11. Responsibility

11.1. The Seller makes every effort to ensure the accuracy of the information on the Website and the contractual fulfilment of orders.

11.2. The Seller's liability for breach of contract shall be governed by Spanish law. The Seller excludes its liability for any indirect or consequential damages suffered by the Customer (e.g. loss of profit).

11.3. The Seller shall not be liable for delays or non-performance due to force majeure.

11.4. Exclusion of liability for the use of the product: It is the Customer's responsibility to use the Products in accordance with the instructions on the label and on the Website, as well as with the applicable regulations. The Seller assumes no responsibility for the consequences of improper or illegal use of the Products, nor for the individual sensitivity or medical condition of the Customer. Please also read carefully point 4.2.

12. Customer Service, Complaints

12.1. For any query or complaint related to the Products or the order, the Customer may contact the Seller through the contact details indicated in point 1 (mainly: info@canna4bliss.com).

12.2. The Seller will attempt to resolve verbal complaints immediately if possible. In the event of a written complaint, the Seller shall investigate it and respond with a reasoned reply within 30 days at the latest.

12.3. Online Dispute Resolution (ODR) Platform: The European Commission has set up an online dispute resolution platform to resolve disputes related to online purchases out of court. 13. Intellectual Property

13.1. The content of the Website (texts, images, graphic elements, logo, software, etc.) is the intellectual property of the Seller or its licensors and is protected by copyright.

13.2. Any use, copying, reproduction or distribution of the content of the Website is prohibited without the prior written consent of the Seller.

14. Data Protection

14.1. Detailed rules on the processing of the Customer's personal data can be found in the Privacy Policy and the Cookie Policy available on the Website, which form an integral part of these T&Cs.

15. Modification of the T&Cs

15.1. The Seller reserves the right to unilaterally modify these T&Cs. The modifications will come into force with their publication on the Website.

15.2. The changes shall apply to orders placed after their entry into force. Orders already in progress shall be governed by the T&Cs in force at the time the order is placed.

16. Applicable Law and Jurisdiction

16.1. For matters not regulated in these T&Cs, the Spanish legislation (in particular the Civil Code, consumer and user protection legislation and e-commerce legislation).

16.2. The parties shall attempt to resolve any dispute amicably. Otherwise, the Spanish courts shall have jurisdiction. For contracts with consumers, the courts of the Customer's domicile may also have jurisdiction, in accordance with Spanish and EU consumer protection legislation.
